I just accepted a gig for a local sorority. They want to write me a check early, but they want a contract. Never done this before so I really don't know what I'm doing. Can someone help me out?

Inviato Mon 13 Sep 10 @ 6:33 pm
I'd be interested ....
In New Zealand Traditionally for me at least It was No deposit and full amount paid at end of gig, with no written contract.
I think some contracts i've seen on the net no one would book you, here in New Zealand.
And yes i've been caught out a couple of times, one was a 21st were the client spent the DJ money on buying extra alcohol, I did finally get paid thanks to a friend of the client.
Another incident was I was booked to do a up-market function, only to find another DJ setting up, I was double booked!!
So yes im leaning towards a deposit & contract with the balance on the day prior to setup.
I may not require this from Pubs as they always pay OK.

Contracts, booking forms and deposits,
don't fight it, just do it, it will open door's to more professional events. It's just good working practice too
If you ever undertake a proper assignment through an agent, let's say abroad for instance, there will be no question, YOU will SIGN a CONTRACT
DME, share your contract, the idea's to create a really good contract out of them all for everyone to use.
All for one and one for all!!!
It's funny I remember a couple of years ago talking on the phone to a guy that had DJ'd all his life and had never had PLI or PAT, I though this was a bit odd, so I asked him what venues he played in/at and he said pub's n village halls. Obviously, if you just play in villages and in small pub's you might get away with it if never asked to produce cert's to gain entry but why risk it? Anyway, slightly off topic but then again it's all the same to me, just good working practice.

Is there should be something in the contract that actually protects the client? Things like:
- client doesn't owe any monies if the DJ did not show up on time
Or what will happen if the DJ is not able to perform on the day of the event?

A deposit of $5005 is due upon booking the services described above and the balance of $500 is due ___7___ days prior to the start of the event. The Client’s failure to pay the above stated compensation in full prior to the start of the event shall release the disc jockey from furnishing any services to the Client under this agreement and may result in legal action taken against the Client. The Client agrees to furnish a facility that completely covers the disc jockey’s equipment from direct sunlight and rain. The Client further agrees to provide sufficient electrical power within twenty-five feet of the location where the disc jockey’s equipment is set up. Any delay in the performance or damage to the disc jockey’s equipment due to improper power is the responsibility of the Client and legal action may be taken to recover damages. The Client agrees to provide specific directions to the event location, and access for the disc jockey’s set-up at least one and a half full hours prior to the above stated contracted time and 45-60 minutes after the conclusion of the engagement. The Client is responsible for paying any charges imposed by the venue. These charges may include, but are not limited to, parking, use of electric power, use of service elevators.
3. The Client may request that the disc jockey play longer than the time listed above. The disc jockey will provide a longer performance if he/she has no other obligations and the Client is willing to pay current overtime rates which are currently $85.00 per half hour billed in hourly increments. The availability of the disc jockey to play over the scheduled time cannot be guaranteed. Please call the office if you have any questions on our availability to play over the scheduled time and to quote our current overtime rates which are subject to change.
4. Every effort will be made to honor the Clients request for a specific disc jockey (if applicable); however, in the event that the requested disc jockey becomes un-available, the Company reserves the right to send another staff disc jockey. In the event that the Client was charged an additional fee for a specific disc jockey, that portion of the fee will be refunded by the Company.
5. The disc jockey will make every effort to play all requests but cannot be held responsible if specific selections are not available. The disc jockey will not be obligated to play music provided by the Client or the Client’s guest, this is to include but not limited to Ipods, CD’s, Hard drives etc. The disc jockey will make an extra effort to have music request available if they are received IN WRITING at least two weeks prior to the engagement. Every effort will be made to continue the performance; however, safety is paramount in all decisions. The disc jockey’s compensation will not be affected by such cancellation. In the event of circumstances deemed to present a threat or implied threat of injury or harm to the disc jockey, other staff or any equipment in possession of the disc jockey, the disc jockey reserves the right to cease performance. If the Client is able to resolve the threatening situation in a reasonable amount of time (maximum of 15 minutes), the disc jockey shall resume performance in accordance with the original terms of this agreement. Client shall be responsible for payment in full, regardless of whether the situation is resolved or whether the disc jockey resumes performance. In order to prevent equipment damage or liability arising from accidental injury to any individual attending this performance, disc jockey reserves the right to deny any guest access to the sound system, music recordings, or other equipment.
6. This agreement cannot be terminated by any of the parties hereto, but is subject to proven detention by sickness, accidents, equipment malfunction or acts of God beyond the control of the disc jockey. In the unlikely event that the disc jockey is unable to appear, the Company will make every effort to find a qualified substitute replacement. In the unlikely event that a replacement cannot be found, the Company will make a full and prompt refund of any deposit or monies paid by the Client, however, the Client agrees that under all circumstances, the Company’s liability shall be exclusively limited to an amount not to exceed the performance fee, and the Company shall not be liable for indirect or consequential damages arising from any breach of contract. In the unlikely event that the disc jockey is delayed and the event does not start on time, or time is lost during the event due to equipment malfunction, the Company will refund the portion of fees paid prorated to the time lost. This is the full extent of the Company’s liability.

Nice thanks a lot guys. Very appreciated.
Also there should be a close somewhere on if the DJ is to provide the Sound system (Clubs & Lounges) or the arrangment if the Clients are to provide the Sound.
Also there are cases where the DJ is providing the sound and he has to perform in a certain floor in a venue with no elevators. Accessibility issue. (Not fun at all).
Here is another situation that's kinda tedious. In some venue (Clubs) the sound system is horrible, the crowd tend to blame it on the DJ. That can really hurt the DJ image.
I also think The client has to be aware of the equipment the DJ will be performing on. I had one experience one time where after setting up my tts, speakers, few lightings, power stations, the client was all glowie and happy and as soon as i pulled out my laptop the guy went ballistic. Even after trying to explain the him the Digital DJing concept, showing him my music HD, my music folders, and have him next to me for a while before the party starts so he can really understand what I was about to do, he still was not convinced. To him I was not "live", my stuff were "pre-mix" and "save" on the laptop. You would not believe it; that night gave me a lot of business, every one had a blast except the clients.
