Looking throudh their legal disclaimer, I noticed that there was no "share to belong" clause. However, there WAS a clause that essentially states that, if you DO share, you'd better have every right, lisence, and permission, or face a charge of $5 per item shared if you don't.
"Violation of Copyright, Dissemination, Spamming and Damages
We will immediately terminate your use of Qtrax which we believe, in our sole discretion, is being used to violate copyrighted works, disseminate viruses, worms, Trojans and the like, disseminated illegally obtained files, child pornography, and all such file types prohibited by law, transmit or is otherwise connected with any spam or other unsolicited bulk email, defamatory or offensive contents contained in the files, propaganda and the like and you may be liable to damages by reason of such wrongful conduct.
If actual damages cannot be reasonably calculated then you agree to pay us liquidated damages of $5 for each piece of file type disseminated illegally, spam or unsolicited bulk email transmitted from or otherwise connected with you, otherwise you agree to pay us actual damages, to the extent such actual damages can be reasonably calculated."

the official launch day of last monday has been and gone with all four major music companies pulling away from the deal stating qtrax had moved the goalposts on the original deal of method of payment to them and their artists
with all downloads to the end user being free, royalties were to be raised for each record company through advertising on the site with which they now don't think will be high enough, negociations are ongoing said a spokesman for qtrax who hope to announce a new release date soon for this service
hope they include video at some future point

Well, the CNN report clearly states that DRM is a part of their paradigm...Not very appealing. Buying CDs means that you can make a backup and beat that up out in the field (not that I do this anymore, necessarily, now that I went digital), keeping your original pristine for safety's sake, while DRM means that you can't burn a backup CD in case of some unforseen catastrophe, like a crash, for example, where you would have a backup of at least the set that was planned for the gig to chuck into your backup CD player until you can sort things out :-(
