I see all this Napster talk.. and I also subscribe.. I usually have most of the stuff downloaded ahead of time and in my library and database search.. My question which came up in conversation is the use the songs from Napster or my Cd's do I have to send ASCAP or someone money for use.. private parties, weddings.. I know most clubs take care of this themselves.. but what about those parties and weddings? Is my monthly payment to Napster cover me for this?
thanks... just curious ( and wanting to stay legal )

my guess is yes,
you might want to read the terms and condition of napster to be sure.

Here in the US...
Basically from what I understand is this...
Private Parties and Weddings are "Private Events" so no licensing from you is needed for you to play them, etc...
Because the HALL you play in and those BARS/PUBS/CLUBS usually have already legally paid for the licensing of music to be played in their establishments, etc...
So only if you are holding and promoting your own "Public" event in which you charge a fee to enter, then you must have the music licensing to play, etc...

I have recently found out (according to preacher at promo only) if you "purchase" music from the download services...wal-mart, rhapsody, yahoo, etc. they are licensed only for personal use and NOT public performance REGARDLESS of whether you or the venue pays the ASCAP, BMI and SEASCAM extortion money.
So strictly speaking you can not use them in any paid dj performance and (for those of you who play at clubs for free because the cheap owners won't pay you and your self respect is so low you agree to it) you can not play them at any club environment that is open to the public.
with that being said until a GOOD download service is created for ALL types of dj's I will still buy stuff at wal-mart on line and take my chances that they won't come after a slug like me for the 3-4 rock songs per month I pay to download from them.

If what you said is true, then how come when the new Napster first came back was it advertised by PCDJ. Obviously there had to be some knowledge that this was going on.
Look at it this way, instead of buying these tracks you are leasing (same as a car). Provided you dont strip the DRM there shouldnt be any harm if all the royalities are paid by the club, bar.
I have been using Napster since it first came back and never once had an issue and there are plenty other users who use it as well. I wouldnt worry.
This is just my opionion, does not reflect the opinion of Atomix, VDJ, or anyone else for that matter.

Here's an excerpt from a DJ Times interview with ASCAP's Jim Steinblatt, New York based director of media relations, and Laurie Hughes, the director of business affairs in their Nashville office.
"a wedding, a birthday party, that kind of thing, would generally be a private performance and not something that ASCAP would license."

Hope this helps.
